What data do we collect?

Fictive Reality may collect the following data:

• Your email address - if your mode of registration provided it
• Your name - if you provide it
• Audio recordings of your sessions with our AI - they are private but recorded for the AI to be able to respond
• Video recording of your sessions with our AI - only in selected scenarios and only if you choose to provide it
• Session ratings and feedback - only if you provide it

How do we collect your data?

When you sign up for or get an account created with us, we may collect your email address and name in order to identify you, but there are ways to use our product without providing that.

If you use our app to create a session, e.g. when you talk with our virtual avatars for practice, interviews or similar, we will need to record what you say and may also record video in some cases. You will be informed when this happens.

How will we use your data?

Email: We use this to authenticate you and to contact you about the service.

Name: We use this to display your name to yourself and others in your organization.

Audio and video recordings: These are processed in order for our AI actor to understand what you are saying and how you are saying it.

Text content of conversations with the AI actor: Normally, we do NOT consider the text content of conversations with the AI actor to be personal data.

It's important to note that by default your sessions transcripts and recorded audio and video is private and you decide if you share it with administrators, teachers, managers or colleagues.

If you agree to this policy, Fictive Reality may at times share your data with sub-processors. This is never for the purpose of marketing, but just for the purpose of delivering the service.

We work with established cloud, communication and AI providers as data processors under data processing agreements. All of them process data within the EU/EEA. We do not publish specific model names or versions, as the underlying technology is continuously improved.

No model training: Your conversations, transcripts, audio and video recordings are never used to train AI models, neither by Fictive Reality nor by any of our providers. They are processed solely to deliver the service to you.

How do we store your data?

EU data storage: All your data is stored and processed within the EU/EEA, and is encrypted both in transit and at rest. We do not transfer your personal data outside the EU/EEA to deliver the service.

Fictive Reality will keep your data for the duration of your account being present. Once you have requested to cancel your subscription or delete your account, we will delete your data within 90 days.

Artificial Intelligence

The Fictive Reality system utilizes several AI technologies to deliver the service.

• When talking to an AI Actor, the dialogue is generated by one of several general purpose large language models
• When talking to an AI actor, your voice is interpreted into text by a Speech-to-text AI model
• When talking to an AI Actor, the actor's voice is generated by a Text-to-speech AI model
• After receiving a session report, feedback and advice on the dialogue may be generated by various AI models
• When creating training scenarios, AI may be used to suggest texts in the scenario contents

Fictive Reality intends to comply with the EU AI Act. Based on the official compliance checker:

• Fictive Reality AB is a provider of an AI System that we call "Fictive Reality"
• No downstream modifications by other deployers, distributors or importers are made on our system
• Our AI system is NOT considered a high-risk system
• Fictive Reality AB is placing our AI system into service within EU
• Our AI system is not considered an excluded system per Article 2
• Our AI system is not considered a prohibited system per Article 5
• Our AI system is interacting directly with people and is generating synthetic audio, image, video or text content

Based on above, we have the following obligations:

• Ensure that AI systems intended to interact directly with people are designed and developed so that users are informed that they are interacting with an AI system
• Ensure that the outputs of the AI system are marked in a machine-readable format and detectable as artificially generated or manipulated
• Ensure that technical solutions are effective, interoperable, robust and reliable
• Ensure a sufficient level of AI literacy for our staff

Marketing

Fictive Reality may occasionally email you to request your feedback about the app or to share updates with you on what our applications can do.

What are your data protection rights?

Fictive Reality would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:

• The right to access – You have the right to request copies of your personal data.
• The right to rectification – You have the right to request that Fictive Reality correct any information you believe is inaccurate.
• The right to erasure – You have the right to request that Fictive Reality erase your personal data, under certain conditions.
• The right to restrict processing – You have the right to request that Fictive Reality restrict the processing of your personal data.
• The right to object to processing – You have the right to object to Fictive Reality's processing of your personal data.
• The right to data portability – You have the right to request that Fictive Reality transfer the data that we have collected to another organization.
